In consideration of the surety, through its representatives, producers, issuing or causing to be issued the Bond, you agree to the following terms and conditions:
The premium is not refundable except as stated below.
Paralex Logistics Limited through its staff, representatives or privies, shall have control over you and jurisdiction over you during the terms for which the Bond is in effect and shall have the right to apprehend, arrest and surrender you to the proper officials at any time as provided by the Administration of Criminal Justice Act and other state Laws. In the event your surrender is made prior to your failure to appear in court, and for reasons other than as stated in Paragraph 3, then you may be entitled to a refund of the Bond premium if required by applicable law (if any).

1. Unless otherwise provided by applicable law (if any), the following events shall constitute a breach of your obligations to the surety, and the surety shall have the right to immediately apprehend, arrest and surrender you, and you shall have no right to any refund of premium whatsoever:

2. You depart from the jurisdiction of the court without the prior written consent of the court and the surety.

3. You move from your current address without prior written consent of the surety or you fail to notify the surety of any material information.

4. You sell or dispose of any of your collateral or security registered with the surety, without informing the surety and obtaining a written consent from the surety approving such sale or disposal.

5. You commit any act that constitutes reasonable evidence of your intention to cause a forfeiture of the Bond.

6. You provide false information in your Bond Application and Agreement form.

7. You are arrested and incarcerated for any other offense.

8. Any of your family members or next of kin filling the Bond Application and Agreement form provides false information.

9. Your bail is increased.

10. Your spouse or next of kin requests that you be surrendered.

11. There is a material increase in the risk assumed by the surety (as determined by the surety in its sole discretion) including by way of example but not limitation, any security or collateral given for the bond depreciating in value.

12. You agree that the Surety may monitor and track your movements within and outside the jurisdiction of the court at anytime as they wish and without any notice to you. You further agree that the Surety may use modern location technologies such as (but not limited to the examples), trackers etc. To locate your wireless device, vehicle etc. At any time during the period of your bail.

13. You agree that the Surety possesses a lien over your property or properties whose value when summed up can pay off the total bail sum. You agree to submit your title and ownership documents of the property or properties you have listed in the Bail Bond application form to the Surety. The Surety shall hold on to these documents for the duration of the time it stands as Surety for you. In the event that you abscond and cannot be found by the Surety to present you to the court, you agree that the Surety can dispose of your property or properties whose title and ownership document are with the Surety, in order to pay the total sum to the court.

14. You shall indemnify the surety and keep the surety indemnified and hold it harmless from all liabilities, losses, fees and expenses arising out of the Surety’s procurement of the Bond including but not limited to the following:

15. The principal amount of any forfeiture of, judgement on the Bond, any related court cost, interests and legal fees incurred,

16. Fugitive recovery fee if there is a forfeiture of the Bond (which is 10% of the amount of the Bond), including any out of pocket expenses,

17. Any cost incurred in apprehending you and returning you to the Surety or the Court.18. To the maximum extent permitted by the applicable law, you waive any and all your rights under the law and consent to and authorize the surety to obtain any private or public information or records concerning you, from any person or agency, private or public, including but not limited to criminal records, previous convictions, tax records, employment records etc. You further authorize any person or agency, private or public contacted by the surety to furnish them with any record or information in their possession concerning you to the surety and direct that a copy of this document shall serve as evidence and authorisation. You irrevocably grant to the surety and its staff, representatives and privies the right to enter your residence or any other property owned or occupied by you, without notice, at any time, for the purpose of locating, arresting and returning you to custody, or the jurisdiction of the court.
You waive any and all causes of action in connection therewith, including but without limitation, torts of trespass, kidnap and false imprisonment.

19. If you leave the jurisdiction of the court, you consent to the application of force as may be necessary to bring you back to the surety and to the court where the bond was posted.

20. You hereby acknowledge and agree that neither the surety nor any of its staff, agents, representatives, privies has recommended or suggested any specific lawyer or law firm to represent you in any capacity.

21. In the event that any provision herein is deemed to have exceeded the applicable laws, then such provision shall automatically be deemed to have been revised to comply with such law so as to provide the surety with maximum protection from any loss or liability. The invalidity or unenforceability of any provision herein or portion of any provision, shall in no way affect the validity or enforceability of other provisions of this terms and conditions. The surety may assign any of its rights herein to any party including without limitation, to any of the surety’s agents, representatives, and privies (“Assignee”) without notice to you or any consent from you. Subject to any limitations imposed on the Assignee by the surety, the Assignee shall have the right to enforce in any action, any of the Surety’s rights arising out of any of the transactions contemplated herein. You hereby expressly waive any right to assert the claim or defence that that the Assignee does not have the right to enforce such rights in any action or proceeding against you.
